1. About these terms and who provides the service
These Terms of Use ("Terms") apply to the AnimateMyRoute app, the website at https://animatemyroute.com, and our online route and support services. We call these the "Service". Ember Oak Studios, an independent app publisher based in Ireland, provides the Service ("we", "us" or "our").
By downloading or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use it. Google Play's terms also apply to downloads and purchases made through the store. If its terms conflict with ours on payment or app distribution, Google Play's terms take priority for that issue.
These Terms do not take away any consumer rights or remedies that the law says must apply.
2. Who can use AnimateMyRoute
You must be at least 16 to use AnimateMyRoute independently. If you are under 18, a parent or guardian must review these Terms and supervise any purchase. If you use the Service for a business or other organisation, you confirm that you are allowed to act for it.
3. How you can use AnimateMyRoute
We give you personal, limited permission to install and use the app on compatible devices for lawful personal or business creative work. You cannot transfer or sub-license this permission, other people may receive the same permission, and we can withdraw it as explained in these Terms. Open-source licences also apply to the relevant parts of the app.
You can use the videos you make, including for commercial work, as long as you have the right to use everything you add and you keep the required map credits. You do not gain ownership of the app, its code, its brand or the artwork included with it.
4. Your routes, photographs and other content
Your routes, photos and other project content remain yours. You are responsible for them and must have permission to use every photo, GPX file, route, name, logo, trademark or other item you add. Do not use the Service to violate anyone's privacy, copyright or other rights.
Projects and selected photos stay on your device and are not uploaded to an AnimateMyRoute account. When you use an online feature, you allow us and the companies named in the Privacy Policy to use the route link, search words, locations and connection details needed to provide and protect that feature.
Please keep your own backups. You can permanently lose projects if you delete the app, clear its storage, replace your device or your device fails.
5. Route and map accuracy
AnimateMyRoute uses a shared Google Maps route only to read its stops. We are not connected with, sponsored by or endorsed by Google. Other companies rebuild the route between those stops, so it may differ from Google Maps, the journey you expected or current road conditions.
Place names, routes and maps can be incomplete, wrong, out of date or unavailable. AnimateMyRoute makes videos; it is not a navigation or emergency app. Do not rely on it for live directions, personal safety, road access or emergency decisions. Always follow official signs, restrictions, laws and current travel advice.
Online features depend on other companies that host and protect the service, find places and provide maps and routes. Our Privacy Policy lists these companies and the information they receive. Their own terms and policies also apply to their services and data.
6. Saving and sharing your videos
The video sizes, smoothness, speed and quality available depend on your device, its Android version and free storage. Check every finished video before you use it. A project may not look exactly the same on every device or continue to work with future app or Android versions.
You are responsible for following the rules of any app, platform or service where you save, publish or share a video. AnimateMyRoute saves videos without sound, and you must have the right to use any music, footage or other material you add later.
7. Ads and the optional subscription
The free app is supported by Google AdMob. Depending on your privacy choices and whether an ad is available, you may see a full-screen ad before the app creates your video. Our Privacy Policy explains your choices. We cannot promise that ads will always be available or relevant.
The optional Remove ads subscription hides AnimateMyRoute ads while Google Play says your subscription is active. It does not unlock extra creative tools. The subscription renews each month unless you cancel it in Google Play. The price, taxes, billing period, offer and renewal details shown by Google Play before you buy are the final terms.
- Google Play charges the payment method you choose.
- You can manage or cancel the subscription in Google Play. Deleting the app does not cancel it.
- Cancellation normally takes effect at the end of your paid month, so ads stay hidden until then.
- Google Play's rules and the law that applies to you cover refunds, failed payments, price changes and cancellation rights.
- Restore subscription asks Google Play to check the account currently used on your device.
If Google Play temporarily cannot confirm your subscription, the app may keep ads hidden while it tries again. Ads may return once Google Play confirms that the subscription has expired, been refunded or been cancelled.
8. What you must not do
When using AnimateMyRoute, you must not:
- break the law, commit fraud or violate another person's rights;
- add or share material you do not have permission to use;
- use a route animation for live navigation or present it as trusted safety information;
- remove, hide or crop the required map credits from a finished video;
- send automated, excessive or abusive requests to the online route service;
- test, bypass or defeat app checks, fair-use limits, access controls or security measures;
- extract or misuse passwords, security keys, provider data or private parts of the service;
- reverse engineer or redistribute the app unless the law clearly allows it; or
- interfere with the Service, another person using it or a company that helps provide it.
9. Who owns the app and why map credits matter
Ember Oak Studios or its licensors own AnimateMyRoute's code, design, name, logos and original included artwork. These Terms do not give you permission to use our branding or distribute the app unless we clearly allow it.
Software and data provided by others remain covered by their own licences. OpenStreetMap data uses the Open Database Licence. The required OpenMapTiles and OpenStreetMap credits must stay readable on maps and in saved videos, and the app may also show an OpenFreeMap credit. 10. Changes, updates and availability
We aim to keep the Service reliable, but we cannot promise it will always be available. Other companies run the maps, routes, ads, payments, app store and network services. These may be slow, unavailable, limited or changed for reasons outside our control.
We may fix the app, change the companies we work with, add or remove features, adjust fair-use limits or stop part of the Service when reasonably needed for security, compatibility, the law, provider changes or sustainable operation. You may need to update the app to keep using online features. Where practical and legally required, we will give reasonable notice of an important change.
11. Stopping your use or blocking online access
You can stop using the Service and uninstall the app at any time. Uninstalling does not cancel a subscription, so remember to cancel it separately in Google Play.
We may limit, pause or block an app installation's online access when we reasonably believe this is needed to stop misuse, a security threat, illegal activity or a serious breach of these Terms. If you think a block is a mistake, contact support with the installation ID shown in Settings. Terms about ownership, disclaimers, liability and governing law continue to apply after your use ends.
12. What we can guarantee and our responsibility
We provide the Service with reasonable care, but routes, maps and saved videos can contain mistakes, and online features can be interrupted. As far as the law allows, we do not make extra promises that the Service will always work, be free from errors, meet a particular professional need or work with every device.
Nothing in these Terms removes our responsibility for fraud, a fraudulent statement, death or personal injury caused by negligence, or anything else the law says we cannot exclude. Apart from this, we are not responsible for losses that could not reasonably have been expected when you accepted these Terms, business losses suffered by a consumer, or losses caused by your content, misuse, missing backups, another platform or a service outside our reasonable control.
If you use the Service for work, you are responsible for checking that it meets your professional, legal and backup needs. Nothing here changes the consumer rights you have under the law that applies to you, including Irish consumer law where relevant.
13. Which law applies, changes to these Terms and contact
Irish law governs these Terms. If you are a consumer, you still keep any legal protections that must apply in the country where you normally live, and you can use any court available to you under consumer law. If you use the Service for business, only the courts of Ireland will handle disputes.
If a court decides that one part of these Terms cannot be enforced, the rest still applies. A delay in enforcing a term does not mean we give up that right. You cannot transfer these Terms without our permission. We can transfer them as part of a reorganisation or transfer of the Service, as long as this does not reduce your rights.
We may update these Terms when the Service, the companies we work with or the law changes. We will post the new Terms here with a new effective date. For an important change, we will give reasonable notice where practical. If you keep using the Service after that date, the new Terms will apply.
